Abu Dhabi: The Al Ain Court for Civil, Commercial and Administrative Cases ruled that a young man must pay a man Dh16,000, which he unlawfully seized, in addition to Dh3,000 in compensation.The Court confirmed that the proven criminal conviction of the defendant for the incident settled the common basis between the two lawsuits.A man filed a lawsuit against a young man, demanding that he pay him Dh16,000, legal interest, and Dh5,000 in compensation, in addition to fees, expenses, and charges, stating that the defendant obtained a sum of money belonging to him without any financial or contractual relationship or prior acquaintance between them.For its part, the Court explained that the defendant was convicted in the criminal case on the charge of obtaining an amount of money belonging to the victim under circumstances that suggest the illegitimacy of its source. Therefore, this ruling has settled the common basis between the civil and criminal cases. It noted that the defendant did not return the amount, nor did he appear to defend the case.The Court confirmed that the defendant’s mistake was proven, and resulted in material and moral damage, represented by the plaintiff’s failure to benefit from the seized amount and his feeling of psychological pain. Causation was established between the mistake and the damage, and the defendant was obligated to provide compensation.The compensation for the damages was estimated at Dh3,000.The Court ruled that the defendant must pay the plaintiff Dh19,000, plus expenses, and rejected the rest of the claims.
